Welcome to EldoCardo.

These Terms of Service ("Terms") apply to purchases made through the EldoCardo online store and govern the contractual relationship between EldoCardo and its customers.

Mandatory statutory rights, in particular consumer rights under applicable German and European Union law, remain unaffected by these Terms.

2. Customers

Customers must be legally capable of entering into contracts under applicable law.

When placing an order, customers are responsible for providing complete and accurate information necessary for processing and delivering the order.

3. Products

EldoCardo specializes in collectible trading card game products, including but not limited to:

  • Booster Packs

  • Booster Displays

  • Starter Decks

  • Gift Collections

  • Premium Collections

  • Accessories

  • Promotional Cards

  • Singles and graded cards, where available

The essential characteristics of each product are described on the respective product page.

4. Product Images and Descriptions

Product images are intended to represent the offered product as accurately as reasonably possible.

Depending on the product and manufacturer, minor differences may occur regarding packaging, artwork, logos, print runs or manufacturer revisions.

Where such characteristics are material to the specific product offered, the information provided in the respective product description applies.

Nothing in this section limits statutory rights relating to goods that do not conform to the agreed characteristics.

5. Product Condition and Collectible Products

Unless otherwise stated in the respective product description, products are sold in the condition specified on the product page.

Trading card products may exhibit manufacturing or packaging characteristics such as:

  • print lines;

  • centering variations;

  • minor seal irregularities;

  • wrapper folds;

  • minor packaging imperfections; or

  • factory surface marks.

Whether such a characteristic constitutes a defect depends on the individual circumstances and the characteristics agreed for the respective product.

Mandatory statutory rights relating to defective goods remain unaffected.

6. Product Languages

Products are supplied in the language version stated on the respective product page.

Available languages may include, among others:

  • English

  • Japanese

  • German

  • Simplified Chinese

  • Korean

Customers should verify the stated product language before placing an order.

Ordering an unintended language version does not affect any statutory right of withdrawal or other mandatory consumer rights that may apply.

7. Prices and Taxes

The prices displayed on the website at the time an order is placed apply to that order.

Unless otherwise indicated, prices displayed to consumers include applicable value-added tax where required by law.

Any applicable shipping charges are displayed separately during checkout before the customer submits the order.

In the event of an obvious pricing or technical error, EldoCardo reserves the right to correct the error in accordance with applicable law.

8. Ordering Process and Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer but an invitation for the customer to place an order.

By completing the checkout process and submitting the order, the customer submits a binding offer to purchase the selected products.

The exact point at which the contract is concluded depends on the payment method and the order confirmation process used during checkout.

An automatically generated acknowledgement confirming receipt of an order does not necessarily constitute acceptance of the order unless expressly stated otherwise.

EldoCardo may reject an order where permitted by applicable law, for example where the ordered product is unavailable, payment cannot be processed or there are reasonable indications of fraud or misuse.

9. Payment

Available payment methods are displayed during checkout.

The customer must pay the amount due according to the conditions of the selected payment method.

Where a third-party payment provider is used, additional terms of that payment provider may apply.

If payment cannot be successfully processed, the order may not be accepted or may be cancelled where legally permitted.

10. Pre-Orders

Products marked as Pre-Order are products expected to become available at a future date.

Any stated release or availability date is based on information available from the manufacturer, distributor or supplier at the time of publication.

Release dates may subsequently be changed by manufacturers, distributors or other suppliers.

Where legally permissible, shipment will take place once the ordered pre-order product becomes available.

Any applicable statutory cancellation, withdrawal and consumer rights remain unaffected.

11. Supplier Allocations and Product Availability

Trading card products may be subject to manufacturer or distributor allocations.

In exceptional circumstances, a supplier may provide EldoCardo with fewer products than originally ordered or confirmed.

If EldoCardo is unable to supply an ordered product, the customer will be informed without undue delay.

Amounts already paid for products that cannot be supplied will be refunded.

EldoCardo will not substitute a different product without the customer's agreement.

Mandatory statutory rights remain unaffected.

12. Orders Containing In-Stock and Pre-Order Products

If an order contains both immediately available products and pre-order products, the order may be shipped together once all products are available if this was communicated during the ordering process.

Customers who require immediately available products to be shipped separately may need to place separate orders or select an available separate-shipping option.

The information displayed during checkout applies to the respective order.

13. Purchase Limits

EldoCardo may impose reasonable purchase limits on products with limited availability.

Any applicable purchase limit will be communicated in connection with the respective offer where appropriate.

Orders intended to circumvent clearly communicated purchase limits may be cancelled or adjusted where legally permissible.

14. Delivery

Available delivery destinations, shipping methods and shipping costs are displayed during checkout.

Delivery times stated in the online store are based on the information available at the time of ordering.

For pre-order products, the specific provisions regarding pre-orders apply.

Statutory rights in the event of delayed delivery remain unaffected.

15. Cancellations and Right of Withdrawal

Customers may contact EldoCardo if they wish to request cancellation of an order before shipment.

Whether an order can be cancelled outside a statutory right depends on the processing status of the order.

Consumers may additionally have a statutory right of withdrawal.

Mandatory statutory consumer rights remain unaffected.

16. Defective or Incorrect Products

If a product is defective, does not conform to the agreed characteristics or an incorrect product has been delivered, statutory warranty and consumer rights apply.

Customers are encouraged to contact EldoCardo promptly if there is an issue with an order so that the matter can be investigated and resolved.

Any request for photographs or additional information is intended to facilitate processing and does not limit mandatory statutory rights.

17. Graded Cards

Where professionally graded trading cards are offered, the grading company and assigned grade will be stated in the respective product description where applicable.

The grade represents the assessment of the respective third-party grading company.

EldoCardo does not independently guarantee that another grading company or a subsequent regrading would assign the same grade.

Any specific slab condition or defects known to EldoCardo will be described where relevant.

Mandatory statutory rights remain unaffected.

18. Fraud Prevention

Orders may be subject to reasonable security and fraud-prevention checks.

Where there are reasonable indications of unauthorized payment, fraud or misuse, EldoCardo may delay processing while the matter is reviewed or may reject or cancel the order where legally permitted.

Any additional information requested will be limited to what is reasonably necessary for verification.

19. Intellectual Property

Original EldoCardo content, including branding, original graphics, texts and other original website content, is protected by applicable intellectual property laws.

Third-party product names, trademarks, characters, artwork and logos remain the property of their respective rights holders.

The sale of third-party products does not imply sponsorship, endorsement or affiliation unless expressly stated.

20. Acceptable Use

Users must not intentionally:

  • interfere with the proper functioning or security of the website;

  • introduce malicious software;

  • attempt unauthorized access to systems or accounts;

  • misuse the ordering or payment systems; or

  • use the website for fraudulent or unlawful purposes.

21. Collector and Market Value Disclaimer

Trading cards and related products are collectible goods whose secondary-market values may fluctuate.

Unless expressly agreed otherwise, EldoCardo does not guarantee:

  • future market value;

  • investment performance;

  • future scarcity;

  • grading outcomes; or

  • the contents or monetary value of randomly distributed cards contained in sealed products.

No statement regarding potential collectible value should be understood as financial or investment advice.

22. Manufacturer Changes

Manufacturers may make changes to product packaging, artwork or other product characteristics.

Where such changes do not affect characteristics contractually agreed with the customer, minor manufacturer changes may occur without prior notice.

Where a change materially affects the agreed characteristics of the ordered product, applicable statutory rights remain unaffected.

23. Liability

EldoCardo is liable without limitation for damage resulting from intent or gross negligence and for injury to life, body or health resulting from negligent or intentional breach of duty.

EldoCardo is also liable where liability is mandatory under applicable law, including applicable product liability provisions.

In cases of slight negligence involving the breach of an essential contractual obligation, liability is limited, where legally permissible, to foreseeable damage typical for this type of contract.

An essential contractual obligation is an obligation whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may regularly rely.

Mandatory statutory liability remains unaffected.

24. Events Outside Reasonable Control

Events outside EldoCardo's reasonable control, such as significant transport disruptions, natural disasters, government measures or manufacturer and supplier disruptions, may affect fulfilment.

This provision does not exclude or restrict any mandatory statutory rights of customers, including rights relating to non-delivery, delay, withdrawal or reimbursement.

25. Severability

If any provision of these Terms is invalid or unenforceable, the validity of the remaining provisions shall not be affected.

Where applicable, statutory provisions shall apply in place of the invalid or unenforceable provision.

26. Changes to these Terms

EldoCardo may update these Terms for future transactions.

The version applicable to an order is generally the version made available to the customer when the order is placed.

Changes made after an order has been placed do not retroactively alter an existing contract unless legally permissible and agreed where required.

27. Governing Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), to the extent legally permissible.

For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable under the law of the country in which they have their habitual residence where such protections cannot lawfully be excluded by agreement.
